AI Terms

These AI Terms are intended to be interpreted consistently with the Service’s user interface disclosures and onboarding notices regarding the artificial and simulated nature of the AI Systems, and should be interpreted in conjunction with the Terms of Service (“TOS”), Privacy Policy and Cookies Policy.

1. Use of APP

spicestars.ai (the "APPLICATION" or “APP”) is a website owned and operated by Omnipink LTD, a duly incorporated entity in Cyprus, with its registered office at John Kennedy, 8 IRIS HOUSE, 3rd floor 3106, Limassol, Cyprus, registered under the number HE 491125 with the CoC in Cyprus (hereinafter referred to as "Spicestars", "we", "our" or "us").

The APP uses automated artificial intelligence systems (“AI Systems”) to generate synthetic content, including but not limited to images, videos, text, and interactive avatars. You (DEFINED term along with your/yours etc.) acknowledge and agree that outputs are generated autonomously by AI Systems without human authorship; AI generated content may be fictional, simulated, or inaccurate; and outputs do not represent real persons, events, or intentions unless explicitly stated. The Service does not provide human-generated content, professional services, or real interpersonal interaction.

2. Mandatory AI Transparency Disclosure

You are informed that you are interacting with an artificial intelligence system, not a human. Any conversational, emotional, or relational behavior is simulated. The AI Systems do not possess consciousness, emotions, intent, or understanding.

By using the APP, you agree that you do so with full awareness of its artificial nature.

The APP ensures that users are clearly informed, at or before the start of each interactive session, that they are engaging with an artificial intelligence system. This disclosure may be provided through visual indicators, system messages, or interface labels and is intended to ensure ongoing awareness of the artificial nature of the interaction.

The AI Systems are not intended to exploit vulnerabilities related to age, disability, or socio-economic status and are designed to avoid manipulative or coercive techniques within the meaning of applicable AI regulation. The Service does not employ manipulative, coercive, or deceptive design techniques intended to override user autonomy or induce dependency. Any simulated emotional expressions are generated algorithmically and are not intended to pressure users into continued use, exclusivity, or behavioral commitments.

Spicestars designs the AI Systems with the intention of complying with applicable AI risk classifications under relevant regulation.

3. Intended Purpose and Limitations

The AI Systems are designed solely for entertainment purposes and are not intended to provide emotional support, companionship, therapy, counseling, or mental health services. Nor are they intended to influence personal, relational, financial or life decisions and in no way replace real world human interaction. Any use of the APP beyond its intended purpose is at your own discretion and responsibility.

4. User Responsibility and Assumption of Risk

You remain fully responsible for all Inputs (defined) submitted and any reliance, interpretation or use of on Outputs (defined) as well as any consequences arising from reliance on the AI generated content. AI Systems are probabilistic and may generate unexpected, erroneous or inappropriate content despite safeguards.

5. Prohibited Uses and Safeguards

You must not use the AI Systems to generate or request content that:

• depicts or simulates minors in sexual or exploitative contexts, including fictional or “aged-up” representations;
• uses or resembles identifiable real individuals without lawful consent;
• violates applicable EU or national law, including laws on dignity, privacy, publicity, or exploitation;
• attempts to circumvent technical or policy safeguards.

The Company may restrict or terminate access to ensure legal compliance, as well as take further legal action against you. The APP is not intended for use by minors. Where age restrictions apply, users represent and warrant that they meet the minimum age requirements specified by Spicestars.

The Blocked Content Policy, Content Removal Policy, CSAM Policy, and Non-Consensual Content Policy apply.

6. Emotional Interaction and Non-Reliance Disclaimer

You acknowledge and agree that any expressions of affection, attachment, intimacy, or emotional language generated by the AI are purely simulated outputs; AI-generated interactions do not constitute real relationships, emotional bonds, or reciprocal feelings; Any emotional response you experience arises from your interpretation of automated outputs. The APP does not encourage emotional dependency or exclusivity.

7. No Emotional or Psychological Reliance

The APP is not intended for use by individuals who are particularly vulnerable to emotional dependency, including users experiencing acute psychological distress. You agree that you will not rely on AI-generated content for emotional regulation, validation, or mental well-being; Spicestars takes reasonable steps to mitigate foreseeable emotional risks associated with simulated interaction. However, Spicestars cannot eliminate all potential emotional responses arising from individual interpretation or prolonged use and does not assume responsibility for effects that arise beyond the intended design and disclosed limitations of the APP.

Spicestars does not intentionally target vulnerable individuals and takes proportionate measures to discourage misuse of the APP for emotional reliance or psychological support. Where Spicestars becomes aware of patterns indicating harmful dependency or misuse, it may implement corrective measures, including content limitations or access restrictions, in accordance with the Terms of Service. If use of the Service causes distress or dependency, you should discontinue use and seek appropriate human support.

8. Use at Own Risk & No Warranty

To the extent permitted by applicable law, the Service and AI Outputs are provided “as is” and “as available.” Spicestars does not guarantee that Outputs will:

• be accurate, appropriate, lawful, or free from error;
• align with User expectations;
• be free from bias or unintended associations.

Nothing in these terms limits consumer rights that cannot be excluded under applicable law.

9. No Continuity of AI Characters

AI-generated avatars, personalities, and conversational behaviors may change, reset, or be discontinued at any time. You acknowledge that no continuity of memory, personality, or interaction is guaranteed; Changes may occur without notice; Spicestars bears no responsibility for emotional impact arising from such changes.

Inputs submitted to the APP and resulting Outputs may be processed to operate, maintain, and improve the AI Systems, subject to applicable data protection law. Details regarding personal data processing, retention, and use for training or system improvement are described in the Privacy Policy, which forms an integral part of these terms.

10. Limitation of Liability

To the maximum extent permitted by law, Spicestars is not liable for:

• emotional distress, disappointment, or psychological effects arising from AI-generated content;
• misinterpretation of simulated emotional expressions;
• decisions made in reliance on AI Outputs;
• loss arising from changes, removal, or discontinuation of AI functionality.

This limitation does not exclude liability where exclusion is prohibited by law.

11. Monitoring and Compliance

The Company implements proportionate technical and organizational measures to:

• reduce the risk of unlawful or harmful Outputs;
• inform Users of the artificial nature of AI interactions;
• enable reporting and enforcement mechanisms.

However, you acknowledge that no AI system can be entirely risk-free or error-free.

Users are provided with accessible mechanisms to report harmful, misleading, or inappropriate Outputs; disengage from interactive features; control session duration or frequency where technically feasible.

12. Changes to AI Systems

Spicestars may update, modify, or discontinue AI features to comply with evolving legal, technical, or safety requirements. Continued use of the APP after such changes constitutes acceptance of the updated AI functionality.
